Annexation & Detachment
Is it Possible for a Property to Detach Into Another Township?
Detachment is a real thing that is sometimes confused with annexation. If the merger goes through and you have a piece of property that is not getting services to your area - primarily water and sewer - a property owner can petition to detach to another township or entity.
This happened recently south of Kirkersville. A property detached from Kirkersville and went into Harrison township (our neighboring township to the south).
Here is the link to the court case allowing this to happen: https://researchoh.tylerhost.net/CourtRecordsSearch/ViewCase/57bcd4d9417d4bfc945f8805471d0ba6
SR 158 LLC et al vs. VILLAGE OF KIRKERSVILLE OHIO et al
Case # 2019-CV-01069
The township does have the tools and ability to manage the annexation threat that the yes merger group continues to say is a problem for the township.
JEDDs, TIFs, and NCAs give us the ability to stop annexation and agreements with surrounding municipalities.
You have to sit down and put those agreements together and we have the capability and willingness to commit to do this.
